Cryptography is no longer optional.
On July 1, 2024, the Indian Evidence Act (1872) was officially replaced by the Bharatiya Sakshya Adhiniyam (BSA), 2023. This paradigm shift fundamentally changed how digital documents, source code, and electronic records are admitted as evidence in Indian courts.
Under the new Section 63, mere printed copies or oral affidavits are no longer sufficient. Electronic records now require strict technical formatting, specifically demanding a Cryptographic Hash Value to prove the file has not been tampered with.
